Many different crimes have been committed by states against each other at different stages of history, some of which have been recognized as international crimes because of the horror of the crimes. Unfortunately, the international community, with all its judicial and security authorities is inactive against this crime. Among these nations, the Kurds are a prominent example of a victim nation that has been subjected to many terrible international crimes. The crime committed against the Kurds is the chemical bombing of Halabja in 1988 during the war between Iraq and Iran. The obvious problem of this study is to determine what kind of international crime the chemical attack on Halabja? If it is a crime of genocide, what are the procedures for recognizing it as genocide? What are the obstacles to internationalization? To arrive at these facts, the researcher assumes that if these obstacles are removed and the necessary measures are taken, the crime will be recognized as an international crime of genocide.
