Abstract


Orientalists have paid attention to Islam and its Shari'ah as one of the factors affecting the culture
of the eastern peoples. They have given the importance of the Shari'ah and Sunnah as the second main
sources. It has been the transmission of community customs as it was known in language, but later,
due to local political influences and religious opposition to Umayyad royal rule, the creation of
different jurisprudence schools, the expansion of the size of Islamic society, and new problems Also,
The Qur'an was not able to respond to all these developments. Therefore, the Sunnah gradually
developed as a source of Shari'ah and was attributed to the Prophet (peace and blessings of Allah be
upon him).
Orientalists have read the history of Islamic Shari'ah according to their own cognitive background
and the history of their societies, and They denied its authenticity and privacy. Orientalism has a long
history and great development, but so far, the research of Goldtstr and Shakht has had a great impact
on those who have succeeded them in their understanding of the history of Islam and Sunnah.
