The judiciary is one of the pillars of the state’s entity through the ages. The state cannot exist without an independent and just judiciary which is based on an appropriate philosophy of its kind. Therefore, this research sheds light on the judiciary and the judiciary in Islam in particular which encompasses belief, law, religion, and a state accordingly. The true Islam has laid clear foundations for how to manage the judiciary and the formation of the judicial authority and the legislation that must be followed in the judiciary in order to achieve justice. A justice which is in harmony with the correct Islamic belief, which represents divine justice. Judiciary and Judicial authority established on good foundations will not only protect the houner of people but also will bestow everyone its rights. Lastly, it should be mentioned that this kind of authority will absolutely achieve its goals if implemented appropriately
